			<content:encoded><![CDATA[<p>Something I have been waiting to see addressed in relation to the 3 year contract for the Town Manager is a  part of the Virginia State Code.</p>
<div>
<p style="padding-left: 30px">§ 15.2-1503. Tenure of officers and employees; suspension or removal.</p>
<p style="padding-left: 30px">A. All appointments of officers and hiring of other employees by a  locality shall be without definite term, unless for temporary services not to  exceed one year or except as otherwise provided by general law or special act.</p>
<p style="padding-left: 30px">B. Any officer or employee of a locality employed pursuant to subsection  A of this section may be suspended or removed from office or employment in accordance with the provisions of §§ 24.2-230 through 24.2-238,  if such sections are applicable. Otherwise, any such employee may be suspended  or removed in accordance with procedure established by special act or by  the governing body, if any.</p>
<p style="padding-left: 30px">C. In case of the absence or disability of any officer or employee, the governing body or other appointing power may designate some responsible person to temporarily perform the duties of the office.</p>
<p style="padding-left: 30px">(1997, c. 587.)</p>

<p>This rather makes it appear that the Town Charter and/or Code  would have had to have been changed before said 3 year contract could  have gone into effect. The other localities that I found to have gone  with a longer contract for Town Manager, have specifically generated  ordinances/charter changes in order to support those. My guess is that  the reason for that was this state code.</p>
<p>So, should the town  council have been looking at such a contract without having first  established that there was such a need as to warrant Charter and/or Code  changes. I never heard of any discussions concerning those changes  except for some mumblings on how they could enter into the contract  first, then change the  Charter/Code afterwards. Maybe there are some  lawyers out there who have a better understand of the intent of this  State Code and would care to comment.</p>
<p>Is it possible that the 3  year contract was merely a &#8216;smoke screen&#8217; simply to get people riled up  so that they wouldn&#8217;t see what was really going on. If so, then you have  to wonder who the &#8216;they&#8217; is in this situation. Certainly with Showalter  and Carter being the last to find out anything, they are ruled out.</p>
<p>Of  course, the town attorney was in the meetings so if this was actually  an issue, one would expect it to have been raised.</p>
<p>Fortunately,  the State Code also makes sure that the public will know the full extent  of the severance packages of any individuals to which they have or  shall be awarded. If it is consistent with the document read by Mr.  Barber, there are some pretty vague places that I hope will be clarified  before the deal is finalized.</p>
<p style="padding-left: 30px">§ 15.2-1510.1. Public announcement of severance packages for certain officials.</p>
<p style="padding-left: 30px">Severance benefits provided to any departing official appointed by a  local governing body or school board shall be publicly announced by the local governing body or school board, respectively, prior to such departure.</p>
<p style="padding-left: 30px">(2006, c. 254;  2007, c. 257.)</p>
<p>It sounds like the details should be pretty specific to me,  but I am sure that someone can argue that the Letter of the Law was met  in Mr. Barbers statement. However, I wonder if it will truly meet the  Spirit of the Law. After all, it is the citizen&#8217;s money being used for  any such severance benefits.</p>

			<content:encoded><![CDATA[<p>While I certainly hope the Town of Christiansburg takes the opportunity  to take a close look at what is needed in a Town Manager for a town this  size, the more immediate concern is what happens as of August 1 when  the current Town Manager is out of office. It looks like the Town  Charter will make it interesting:</p>
<p>Here&#8217;s what the Town Charter  says:<span id="more-2133"></span></p>
<p>1) He has 10 days in which to deliver all property, books  and papers:</p>
<p><!-- 	&lt;!  		@page { margin: 0.79in } 		P { margin-bottom: 0.08in } --><span style="color: #000000"><span style="font-family: Helvetica,sans-serif"><span style="font-size: x-small">§</span></span><span style="font-family: Times Roman Italic,cursive"><span style="font-size: medium"> </span></span><span style="font-family: Times Roman,serif"><span style="font-size: x-small">2.1 2. Surrender of Papers and Property.&#8211;If any person, having been an officer of said town, shall not within ten days after he shall have vacated or been removed from office, and upon notification of request of the council within such time as it may allow, deliver to his successor in office all property, books and papers belonging to the town or appertaining to such office, in possession or under his control, he shall forfeit and pay to the town a sum not exceeding five hundred dollars, to be sued for and recovered with costs; and all books, records and documents used in any office by virtue of any provision of this act, or of any ordinances or order of the town council, or any superior officer of said town, shall be deemed the property of said town and appertaining to said office, and the chief officer thereof shall be held responsible therefor. (1954, c. 240) </span></span></span><br />
2) This raises the big question of who his &#8216;successor&#8217; is going to  be if the job has not been advertised and the position filled by that  time. The Town Charter again comes to the rescue:</p>
<p><!-- 	&lt;!  		@page { margin: 0.79in } 		P { margin-bottom: 0.08in } --><span style="color: #000000"><span style="font-family: Helvetica,sans-serif"><span style="font-size: x-small">§</span></span></span><span style="color: #000000"><span style="font-family: Times Roman Italic,cursive"><span style="font-size: medium"> </span></span></span><span style="color: #000000"><span style="font-family: Times Roman,serif"><span style="font-size: x-small">2.14. Duties of Mayor.&#8211;The mayor shall preside at the meetings of the council, voting only in case of a tie, and perform such other duties as may be prescribed by this charter and by general law and such as may be imposed by the council consistent with his office. He shall perform the duties of the town manager during the absence of the town manager or while the office of town manager is vacant. He shall  have power to investigate the acts of the various town officers, members of the police, fire and public works departments and all other departments of the town government, whether elected or appointed. The mayor shall have and exercise all power and authority conferred by general law on mayors of towns and not inconsistent with this charter; and shall, from time to time, recommend to the council such measures which he may deem needful for the welfare of the town. (1 954, c. 240; 1968, c. 173) </span></span></span><br />
Clearly, it will be Mayor Ballengee who is taking over the Town  Manager&#8217;s roles until such time as the position is filled.  Christiansburg is lucky to have an Assistant Town Manager, Barry Helms,  who is very experienced to be the &#8216;right-hand&#8217; of the Mayor.</p>
<p>This  should make for a fairly smooth transition period, providing ample time  for the Town Council to begin development of a job description, job  advertising, and the interviews required to find the &#8216;right person&#8217;.</p>
<p>Perhaps  the Council will even choose to add some citizens to the review  committee as they did with the position of Police Chief. Or, if they  choose to handle it like the Rescue Squad, let the members (citizens)  elect the person they want to fill the position:) (Wouldn&#8217;t that be a  hoot!)</p>
<p>Time will tell, and I&#8217;ll be watching to see what is done. I  am sure it will be an interesting process however it is done.</p>
<p>An  additional side note to this is also found in the Town Charter:</p>

Compensation.&#8211;The council shall by ordinance or resolution fix the salaries of all officers and employees of the town elected or appointed by it, or appointed by its authority and may so far as is not inconsistent with the provisions of the charter, define the powers and prescribe the duties of all such officers and employees. To effectuate the powers conferred by general laws as well as the powers herein specifically granted, the council may employ all such persons as may be necessary. (1 954, c. 240) </span></span><br />
and in the Town Code:</p>

<p><span style="font-family: Times Roman,serif"><span style="font-size: x-small">The Clerk of the Council shall enter in a well-bound book copies of all ordinances and resolutions passed by the Council. The book in which such ordinances and resolutions are thus entered shall be known as the &#8220;Ordinances and Resolutions of the Town of Christiansburg.&#8221; The Clerk of the Council shall index such book. <p>Well, there are the numbers. Feel free to go to the APA site and check  for yourselves. Do remember however, that these numbers do not include  any of the 2010 fiscal year information where a more than $2 million  deficit is hanging. Maybe there is something to be said for Mr. Lemley&#8217;s  &#8216;pay as you go&#8217; philosophy that didn&#8217;t stay around after he left.</p>
<p>The simple fact is that if the &#8216;goes out&#8217; is higher than the &#8216;comes in&#8217;  things have to change. Keeping this 14 year pattern going in the same  direction is only going to worsen the problem. Town Council needs to get  involved in decisions involving expenditures and more aggressively  monitor what is spent and where. The Town Council get routing reports  from the Town Manager and absolutely nothing in this article should come  as a surprise to any of them. After all, it only took me a couple of  hours to get all the reports and set up multiple spreadsheets for  analysis and I am not a high paid professional. In fact, I did it for  free. Now, what will the Town Council do about the budget, expenses, and  revenue?</p>

			<content:encoded><![CDATA[<p><a href="http://www.surveymonkey.com/s/ManagerContract" target="_blank">Town Manager Contract Survey</a>: It is not just about the contract, but also about the timing where outgoing elected officials are pushing to make the decision now rather than to wait for newly elected officials to take office. The people spoke, quite loudly in the last election, as to who they trust with making such decision. Now, there is an end-run going on to try to push through this contract with the Town Manager without the chosen representatives of the people having a voice. For those who voted for Cord Hall, this means the current Council is changing a decades old pattern in order to exert the last bit of control. <span id="more-2116"></span></p>
<p>Over the years, the Town Council has slowly (sometimes not so slowly) diverted almost all of its duties over to the Town Manager. We essentially have a &#8216;show&#8217; council with the Town Manager making virtually all decisions, establishing contracts (i.e. the Aquatic Center), and choosing which laws and ordinance to enforce and when to enforce them (i.e., multiple violations of Erosion and Sediment Control on Town owned property as well as privately owned). The contract is established to maintain it this way, prohibiting the Council from taking back any of that responsibility. Nuff said by me. Please take the survey. It is short, quick and easy. <h2>Radford and Christiansburg have very different contract issues for  very different reasons.<span id="more-2083"></span></h2>
<p>Radford officials have at the front of their concerns list making sure  that citizens are protected by insuring that the position of town  attorney is being put out for bid and a new contract developed. An  interesting aside to this is &#8220;who is writing the contract?&#8221; The rfp and  contract do not, in any way, exclude the current town attorney from  competing for, and winning said contract. It is a far and open process.  Radford is simply joining the growing number of jurisdictions who are  moving to a dedicated attorney.</p>
<p>Christiansburg, on the other hand, is involved with allowing the Town  Manager to compile a contract for him that is in his best interest. The  sample document used by the Town Manager is one that is provided at a  website that focuses on the needs of those appointed officials,  regardless of whether or not it is in the best interest of the Town.</p>
<p>While the contract itself has not become public knowledge, the sample  contract used for the C&#8217;burg Town Manager contract is available online.  Clearly, this is a document written to protect the Town Manager NOT the  town. It will be interesting to see if the town attorney suggests  modifications that support the interests the town or those of the  Manager. It will also be interesting to see which of the &#8216;elected  officials&#8217; are supporting the town&#8217;s interest and which support the  manager&#8217;s interest.</p>
<p>Given the Town of Christiansburg&#8217;s history of getting into contracts,  discovering that mistakes were made, and then struggling to get out of  those contracts (Tourism Development, Blacksburg Transit). It would be  silly for them to enter into ANY contract that lasted for more than one  year.</p>
<p>As to the Town Manager&#8217;s dedication to the citizens of the Town, all one  needs to do is to read the <a href="../../../Public%20Documents/Aquatic%20Center/AGREEMENT_FOR_USE_OF_SWIMMING_POOL-Draft%2011-20-08.pdf" target="_blank">original  contract he set up with VT</a> for the Aquatic Center, then read the <a href="../../../Public%20Documents/Aquatic%20Center/finalacagreementvt.pdf">one  that was finalized after citizen uproar </a>forced a re-evaluation. The  <a href="../../../Public%20Documents/Aquatic%20Center/markupACagreement.pdf" target="_blank">version  here shows the changes made in red</a>. Please note that the Town  Manger was essentially the only one working up this contract with the  Town Attorney reviewing it. He was all but giving the Aquatic Center to  VT.</p>

<p>The calendar entry still maintains that this is a work session only for the discussion of the budget.  On 6/17/10 at 2:10 PM, PR Specialist, Becky Hawke sent out an announcement to some group of people via email. That announcement states the following:<span id="more-2053"></span></span></p>

Christiansburg Town Council will hold a work session on Tuesday, June 22, 2010, beginning at 7:30p.m. to discuss the F.Y.2010-11 Budget.  The meeting will be held in Council Chambers, 100 E. Main St.</p>
<p>While no formal action will be taken, citizens are welcome to attend the work session.</span></p>

<p>In  particular, one relevant section of the Code is noted:</p>
<div style="margin-left: 40px">Subsection D of § 2.1-343 requires that  notice for special meetings only be reasonable under the circumstances,  and be given contemporaneously with the notice provided to the members  of the public body. The question of whether or not it was reasonable to  call this special meeting with only one working day&#8217;s notice is a  question for the courts, and not for this office. Assuming that the  notice was reasonable under the circumstances, the facts indicate that  the public was notified contemporaneously by posting a notice at the  town hall, also assuming that this is the location where notices for  town council meetings are normally posted.</div>
<p style="margin-bottom: 0in">Now, it is just my opinion, but I feel  that it is unacceptable to &#8216;change horses in mid-stream&#8217;.  What has  happened here is that people have been invited to a Square Dance.  Suddenly, someone decides to have a Ballroom Dance instead but hardly  anyone is notified of the change. You do not just randomly change things  on such short notice without good cause. Unless there is an emergency  involving the items on the &#8216;closed meeting&#8217; agenda, Council and the  citizens would be better served by saving that meeting for the next Town  Council meeting and putting in the proper agenda. Section D of State  Code 2.1-343  used the term &#8216; reasonable under the circumstances&#8217;.  However, it also means that the public would have to have been notified  &#8216;contemporaneously by  posting a notice at the town hall &#8230;&#8217;. By use of  the word &#8216;contemporaneously&#8217;, citizens have the right to assume that  citizen notice would have coincided with council members notice of the  meeting. It would also stand to reason that ALL council members were  notified at the same time. While the &#8216;reasonable under the  circumstances&#8217; issue would likely be one for the Courts to determine,  Council members, the Mayor, and the Town Manager all know who knew about  this meeting and when. They know the right thing, the honest thing.  Now, what will they do about it?</p>
<p><em>Is this a good faith effort on the part of Town Council to comply with FOIA and to keep citizens informed?<em> </em></em></p>

			<content:encoded><![CDATA[<p>While there were a lot of unusual things occurring at the last Christiansburg Town Council Meeting (open discussion, raising of issues, asking questions, paring the budget), there was one event during the last few minutes that captured my attention because it revolved around my personal pet peeve, FOIA (Freedom of Information Act).</p>
<p>During the last few minutes,  an event occurred which has not been seen in Christiansburg Council Chamber in decades (if not in forever).<span id="more-2047"></span> The Mayor rose from his seat and picked up a packet of manila envelopes. He told council members that he was passing this out and that it contained &#8220;Confidential Personnel Information&#8221; upon which he hoped Council could act at the next Town Council meeting.</p>
<p>Obviously, this had to be big news for it to be announced in such an unusual manner. (Usually, these things are just passed out to council without citizens having any knowledge.) Clearly, it was intended to make people aware that the information contained was confidential and they wanted the audience to be sure and understand that fact.</p>
<p>Unusual behavior always captures my interest. So, I found myself wondering what could be up? Was someone resigning or something? Was this the resignation of the Chief of the Rescue Squad that some had been expecting? I have been keeping track of bills affecting FOIA and could not think of anything that would have precipitated such a change. Guess my only other option would be to go to the LIS website, pull up the FOIA Codes and start reading again. Here is what I found:</p>
<ul>
<li>From: § 2.2-3705.1. Exclusions to application of chapter; exclusions of  general application to public bodies. The following records are excluded from the provisions of this chapter  but may be disclosed by the custodian in his discretion, except where such disclosure is prohibited by law:
<ul>
<li>1. Personnel records containing information concerning identifiable individuals, except that access shall not be denied to the person who is  the subject thereof. Any person who is the subject of any personnel record  and who is 18 years of age or older may waive, in writing, the protections afforded by this subdivision. If the protections are so waived, the  public body shall open such records for inspection and copying.</li>
</ul>
</li>
<li>§ 2.2-3705.8. Limitation on record exclusions.
<ul>
<li>A. Neither any provision of this chapter nor any provision of Chapter 38  (§ 2.2-3800 et seq.) of this title shall be construed as denying public  access to (i) contracts between a public body and its officers or employees,  other than contracts settling public employee employment disputes held  confidential as personnel records under § 2.2-3705.1; (ii) records of the position,  job classification, official salary or rate of pay of, and records of the allowances or reimbursements for expenses paid to any officer, official  or employee of a public body; or (iii) the compensation or benefits paid by  any corporation organized by the Virginia Retirement System or its officers  or employees.</li>
<li>The provisions of this subsection, however, shall not require public  access to records of the official salaries or rates of pay of public employees  whose annual rate of pay is $10,000 or less.</li>
<li>B. Nothing in this chapter shall be construed as denying public access  to the nonexempt portions of a report of a consultant hired by or at the  request of a local public body or the mayor or chief executive or administrative  officer of such public body if (i) the contents of such report have been  distributed or disclosed to members of the local public body or (ii) the local  public body has scheduled any action on a matter that is the subject of the consultant&#8217;s report.</li>
</ul>
</li>
</ul>
<p><em>As a quick aside, I see that my favorite section of the code still exists:)</em></p>
<ul>
<li><em>§ 2.2-3707. Meetings to be public; notice of meetings; recordings;  minutes.</em>
<ul>
<li><em>H. Any person may photograph, film, record or otherwise reproduce any  portion of a meeting required to be open. The public body conducting the meeting  may adopt rules governing the placement and use of equipment necessary for broadcasting, photographing, filming or recording a meeting to prevent interference with the proceedings.</em></li>
</ul>
</li>
</ul>
<p>When &#8220;Confidential Information&#8221; is involved, one can reasonably expect a &#8216;closed meeting&#8217; to be just around the corner for discussion (remember that no action can be taken during the &#8216;closed meeting&#8217;, just a discussion on the matter to be acted upon. Since the Mayor did note it was confidential personnel information, that narrows the scope of what would constitute such a meeting. This information can also be found in the FOIA. Here are those sections applicable to &#8216;personnel&#8217;:</p>
<ul>
<li>§ 2.2-3711. Closed meetings authorized for certain limited purposes.
<ul>
<li>A. Public bodies may hold closed meetings only for the following  purposes:
<ul>
<li>1. Discussion, consideration, or interviews of prospective candidates  for employment; assignment, appointment, promotion, performance, demotion, salaries, disciplining, or resignation of specific public officers, appointees, or employees of any public body; and evaluation of  performance of departments or schools of public institutions of higher education where  such evaluation will necessarily involve discussion of the performance of  specific individuals. Any teacher shall be permitted to be present during a  closed meeting in which there is a discussion or consideration of a  disciplinary matter that involves the teacher and some student and the student  involved in the matter is present, provided the teacher makes a written request to  be present to the presiding officer of the appropriate board.</li>
<li>4. The protection of the privacy of individuals in personal matters not related to public business.</li>
<li>B. No resolution, ordinance, rule, contract, regulation or motion  adopted, passed or agreed to in a closed meeting shall become effective unless  the public body, following the meeting, reconvenes in open meeting and takes  a vote of the membership on such resolution, ordinance, rule, contract, regulation, or motion that shall have its substance reasonably  identified in the open meeting.</li>

<p>Given the above excerpts from FOIA (the full text is available at <a title="http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+TOC02020000037000000000000" href="http://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+TOC02020000037000000000000" target="_blank">the Legislative Information System website</a>), it would seem reasonable to assume that either someone is resigning or someone is being disciplined. However, in order to make reasonable assumptions, one must be operating within a &#8216;reasonable environment&#8217;. Since we&#8217;re dealing with the Christiansburg Town Council, where the &#8216;reasonable person&#8217; test would be hard pressed to find a basis for comparison, who knows. Rumors are already running rampant with the most common two being the Rescue Chief or the Town Manager are resigning. Perhaps a FOIA request is in order so that if it is refused the actual statue involved would be noted. That would at least give people a general idea but no specifics.</p>

<p>Now,  I am sure that all of you have probably seen more campaign information  this year than ever before. What does this tell you? Well, obviously  there are people who really, really want to win. Maybe they want to win  badly enough to spend lots of someones money on &#8216;advertising&#8217;.</p>
<p>What  it tells me is that there are those who are scared, for perhaps the  first time, that the status quo will not be maintained. Or, maybe there  is concern that if new eyes come into local government, things will  become public that have not become public before. After all,  Christiansburg only discovered the Freedom of Information Act about 3  years ago (although it has been around for about 40 years now).</p>
<p>Now,  how are they treating their opponents. There are a lot of distortions  and lies going around. Campaign signs have been stolen. All of that  seems like a much harder way to prove you are the best candidate than  simply showing what you have done.</p>
<p>How people run their campaign  can also show you how they are likely to treat people who do not share  their goals, values, or beliefs. Are they likely to discuss issues with  you logically, offering the data to support their positions, or are they  just going to stand in defiance and demand that they have their way?</p>
<p>Is  raising or not raising taxes more important that irresponsible  spending? Is making promises that are never fulfilled what you want in a  candidate? Do you want leadership that takes credit for the work of  others and places any blame squarely on anyone else they can find to  blame?</p>
<p>Stop and listen to the candidates. Are they answering your  questions or are they dodging them. During the candidate forums, I  heard a lot of &#8220;mistakes were made&#8221; comments but I never once heard the  comment &#8220;I made mistakes, but I have learned from them.&#8221; Of course,  there is no evidence in the minutes of Planning Commission or Town  Council to indicate that mistakes were acknowledged or that steps were  taken to prevent those mistakes from happening again. In fact, the  minutes show the same mistakes being made over and over again.</p>

<p>The Town of Christiansburg, VA page  at myvaresources.com has a LOT of documents and audio/video recording  links where any citizen can take a look at what government has been  doing in Christiansburg for the past decade. You will see from meeting  minutes that budgets are discussed early in non-election years and late  in election years. You will see a pattern of issues coming up before the  election and then not being supported or addressed until time for the  next election. In short, you will find all of the political games that  you see at the State and National level, right here at your own  doorstep.</p>
<p>As always, check out the information for yourself.  Sometimes change is about going back to the way that things use to be,  where elected officials represented all the citizens not just special  interest groups.</p>
<p>You might also want to remember that the same  Comprehensive Plan that set the stage for the Aquatic Center includes a  goal of having a Civic Center. Is that what&#8217;s next on the agenda? Will  it happen the same way, behind closed doors without citizens being  informed?</p>

			<content:encoded><![CDATA[<p>F.O.I.A. &#8230; now let&#8217;s see where have I heard that before? Oh, yeah! It is that Freedom of Information thing. You know, that thing where at either the National or State Laws clarify a citizen&#8217;s right to access public documents.<span id="more-1481"></span> This law also dictates the criteria for the definition of a public meeting and whereby public meetings must be announced and when those announcements must be made.</p>
<p>There was an area of F.O.I.A., which for me, seemed a bit gray until recent pokes and prods from individuals caused me to go back to look at the law and some of the interpretations of the law. (Investigation into the matter made the answers seem even more gray than before when answers arrived indicating that <span style="font-style: italic">yes public meetings are public meetings except when their not public meetings, and it doesn&#8217;t matter if they are public meetings or not if the topics of discussion are not specific to a specific issue, yet it can be about the general aspects of an issue, except, of course, for those times when it isn&#8217;t:)</span></p>
<p>Okay, I&#8217;ll quit playing around and get to the issue &#8230;<span style="font-style: italic"><br />
</span><br />
What would happen if a group of citizens invited the local &#8216;body politic&#8217; to attend a gathering and 3 or more of those officials attended? Does this, in and of itself constitute a public meeting? Perhaps the most salient discussion on this can be found in the form of a <a href="http://www.opengovva.org/foi-opinions/index.php?option=com_content&amp;view=article&amp;id=36&amp;Itemid=3" target="_blank">FOI Advisory Council Opinion (AO-15-04, July 19, 2004</a>) found on the website of the Virginia Coalition for Open Government.</p>
<p>This opinion was written in response to a question by a citizen who also provided specific details of that meeting. Following a brief discussion of &#8216;<span style="font-style: italic">Beck v. Shelton&#8217; </span>( a court case where 3 members of the same council attended a citizen-organized meeting to discuss traffic and safety issues), the differences between these two events were noted. In the first instance, it was deemed a FOI violation had occurred because of the combination of the presence of 3 members of a Board in an environment where the topic concerned issues that were currently before that political group for decision. In the &#8216;<span style="font-style: italic">Beck v. Shelton</span>&#8216; case, although there were a sufficient number of elected officials present, the content of the discussion did not involve any issue currently before that group.</p>
<p>Simply take the time to read the Advisory Council Opinion above and see what you think. Personally, I think the law could be a bit clearer and a lot of misunderstandings would be corrected. Then there is always that other issue that comes into play when you are dealing with politicians&#8230;.trust. If you know that several people attended a meeting but you were not there, can you trust them when they tell you that no business specific to the jurisdiction was discussed (by business I mean a topic directly related to issues that are being dealt with currently) and that it was informational only, or that all discussion was totally unrelated to the business of the jurisdiction.</p>
<p>In short, it seems that in a situation where the meeting was held to address a specific issue, it feel within the perview of FOI. Where the meeting is held as a general exchange of information with citizens or a group, this does not fall under FOI.</p>
<p>Perhaps most importantly, when the &#8216;waters of FOIA/FOI are murky&#8217;, consider taking the time to go to the Virginia Coalition for Open Government website and look at some of the opinions available there. If you don&#8217;t find an answer, the contact them with a question (you can do it directly at the website). One thing I learned real early in life, growing up in bayou country, if you can&#8217;t see the bottom of the pond/bayou/lake, take the time to check the depth with a pole before diving in head first!</p>

<p>A recent Roanoke Times article &#8220;<a href="http://www.roanoke.com/news/nrv/wb/219822" target="_blank">Town Council plots out Christiansburg&#8217;s future</a>&#8220;, pretty much says it all.</p>
<p>In the first line of the article you will find : &#8220;Town officials have a vision for what they want Christiansburg to look like in 2020.</p>
<p>First off, a true long-range view typically covers, at a minimum, a 20 year time span, NOT 11 years. Secondly, this makes if very clear that the Town officials are thoroughly convinced that they are the only ones who should make a determination of what Christiansburg should look like. Thus implying that what citizens want or think is totally unnecessary. Next, Mayor Ballengee notes he has &#8220;&#8230;always felt we needed to have a long-range plan for Christiansburg&#8230;&#8221; &#8230; duh!&#8230; that&#8217;s what a Comprehensive Plan is about. That&#8217;s what a Capital Improvements Program is about! Since we&#8217;re not making effective use of either of those two, we should try something else? Typically, this type of Vision Statement is the starting part for writing a New Comprehensive Plan. Maybe that is what the Town has in mind? Not likely. They have out of date charter, out of date codes, a comprehensive plan that is inadequate and did not include sufficient quality citizen input to be a fair representation of what citizens want&#8230;.why break up the set! Maybe they are trying to change. I personally doubt it. This just looks like more of the typical &#8216;smoke and mirrors&#8217; distractions of citizens to keep them as ignorant as possible of what is going on. Only time will tell. And, this is one time that I sincerely hope that my expectations are wrong and that a new era of openness and the inclusion of citizens is going to really happen. I will not hold my breath though. Ballengee&#8217;s statement &#8220;We hope our community will embrace this plan,&#8221; pretty much says it all. What plan? Where is it? Where can citizens see it? How can citizens comment on it? You want us to embrace &#8216;it&#8217;, without knowing what &#8216;it&#8217; is, without hearing what we (all citizens) think about what you have decided is best for us? Well, that&#8217;s how it has worked previously. It is the attitude that has lead to massive developments without fair consideration being made of the impact on citizen&#8217;s lives (i.e., traffic, overcrowded schools, increased crime, etc.). Wouldn&#8217;t it be novel if the Town asked for a change instead of dictated?</p>
<p>Now, let&#8217;s get to the meat of the matter. The &#8220;Town&#8221; (those 7 elected and who knows how many appointed/paid employees who are privy to the deep dark secrets of Christiansburg) has a plan that specifically addresses (but not limited to) these issues (from the above Roanoke Times article):</p>
<ol>
<li>Pursuing green initiatives.</li>
<li>Enhancing the system of walking trails and multiuse paths.</li>
<li>Focusing on public information and community relations.</li>
<li>Reviewing and revising the zoning ordinance.</li>
<li>Promoting the new Aquatic Center.</li>
</ol>
<p>Looks, like your guess is as good as mine on the other 15 target issues.</p>
<p>The rest of this article will review some of the history that the Town Council and Town Manager have when it comes to these areas.</p>
<p>Now, it is time for me to play a bit:)<br />
<br /><span style="font-weight: bold">Concering #1: Pursuing green initiatives. </span></p>
<p>What evidence is there to indicate the Town has done anything other than pay lip service in this area. There are a few references to greenspace where developments were discussed but where has the Town Codes done anything but the bare minimum, to meet State Codes?</p>
<p>Sure, a lot of developments have opted for trails rather than sidewalks in subdivisions. And, yes some of those trails do exist, but they don&#8217;t GO anywhere. They are a disconnected, dysfunctional mass of bits and pieces that do not do the &#8216;interconnectedness&#8217; that they were supposed to accomplish. Maybe the Town has been carefully laying out this patchwork quilt project for years without telling anyone what they were doing, but right now, it just looks like a mass of scraps.</p>
<p>In the June 5, 2007 Town Council meeting minutes this reference can be found: &#8220;Town Manager Terpenny drew Council&#8217;s attention to a flier placed at each of their seats regarding green infrastructure in the New River Valley. The &#8220;Green Infrastructure Initiative&#8221; was created by the New River Valley Planning District Commission to educate communities in the New River Valley on how to maintain a network of green infrastructure for healthy and sustainable community growth. An information meeting for Christiansburg is scheduled for June 21 at the Montgomery County Government Center and is open to anyone interested in learning more about this topic. (If you want to know more about this <a href="http://www.nrvpdc.org/GreenInfrastructure/greeninfrastructure.html">Initiative there is a website with information</a>. Perhaps a good place for our public officials to start would be the <a href="http://www.nrvpdc.org/GreenInfrastructure/What%20is%20GI%20061808.pdf">page that explains what Green Infrastructure</a> is. It will certainly point out that this has NOT been a top priority of the Town of Christiansburg! There are also meeting agendas and minutes available to the public at the site.)</p>
<p>The June 19, 2007 Town Council Meeting had a representative from the NRVPDC come and give a presentation. This presentation included documents related to funding opportunity request.)</p>
<p>At that same June 19, 2007 meeting, the Town Council gave unanimous suupport to a Resolution for Green Infrastructure Grant where the NRVPDC would seek a U.S. Department of Transportation Federal Highway Administration Grant to develop a Green Infrastructure Plan.</p>
<p>October 2, 2007, Elizabeth Obenshain, representing the New River Land Trust explained how the town of Christiansburg could participate in that groups efforts to preserve land.</p>
<p>March 4, 2008 the &#8216;<a href="http://www.gogreenva.org/?/who_we_are/faq">Go Green Virginia Initiative</a>&#8216; was discussed. &#8220;Town Council was introduced to the Go Green Virginia initiative started by Governor Kaine and sponsored by the Virginia Municipal League. The initiative is a nationwide effort to conserve energy. Localities must register with VML to participate, and participants will be recognized for success in various areas included in the program. Three information workshops have been scheduled around the State, and the workshop closest to our area will be held in Abingdon on April 22, 2008. Councilman Wade commented that he attended a seminar on the Go Green Virginia initiative at the 2007 VML conference and he learned that localities are not only saving money by participating, but it is also resulting in better treatment of the environment. mayor Ballengee asked Council to spend some time reviewing the information they have received on the initiative and to be prepared to vote on the matter at the next Council meeting. At the March 18, 2008 meeting Council unanimously voted to participate in the Go Green Virginia Initiative sponsored by the Virginia Municipal League. Unfortunately, this late entry into the process meant that Christiansburg was not found in the 2008 Winners list or in the list of VML Certified Green Governments. I wonder if the Town will manage to make the Sept. 30, 2009 deadline for participating in the Challenge for 2009.</p>
<p>On Sept. 2, 2008 Town Council Minutes: &#8220;Go Green Virginia Initiative. Mayor Ballengee presented each Councilmember with a copy of the energy Efficiency Plan prepared for review. After reviewing, modifications will be made as necessary. A copy of the Energy Efficiency Plan is attached and made a part of these minutes.&#8221; Unfortunately, a copy of that document was not provided to me or on the website. (You need to remember that the Minutes provided at the Town&#8217;s website are only the notes of the meetings, the multitude of additional documents that Town Council are provided with are seldom seen by the public eye&#8230;this is one such example.)<br />
<span style="font-weight: bold">Concerning #2: Walking trails and multiuse paths</span></p>
<p>Notice that these are walking trails and multiuse paths, not sidewalks. These have been discussed for years and have not been able to get accomplished. Why? Do to not getting the grants needed to do it, and Town Council&#8217;s unwillingness to part with money for something as mundane as trails and paths when they could get an Aquatic Center instead. Other &#8216;finds&#8217; searching for the word &#8216;trail&#8217; led to places where the first 5 letters of the word &#8216;trailer&#8217; were identified.<br />
In 2005, there was a <a href="http://www.nrvpdc.org/Transportation/greenwaysandpathways_moCO.pdf" target="_blank">Montgomery County Greenways and Pathways Committee</a> that the Town had representation on. Where have there been any reports back to the Town Council concerning any ideas/issues raised by this group. Is the group even still meeting? All of the references to this committee found on the internet are dated in 2005 and 2006. At least <a href="//www.montva.com/departments/plan/issue/linkpgs/grnwy.php" target="_blank">Montgomery County has some information on Greenways, Open Space &amp; Trail Design</a> on their website. maybe the Town can get some ideas from there or the links on that site.</p>
<p>Sept. 16, 2008, Councilman Vanhoozier proposed a pathway along Cambria Street from Sleepy Hollow Road to the Recreation Center. A feasibility study was suggested and Mayor Ballengee directed this matter to the Town Managaer.</p>
<p>The Town Council Meeting Minutes are full of references to the Huckleberry Trail. Most of these were ideas and plans for which there was no intention on the part of the Town to fund. The Town is more than willing to let public donations and groups accomplish the task. They have shown a willingness to let individuals and groups write grants, but the Town has shown no initiative on its own to make these connections to a viable trail system a reality.<br />
<span style="font-weight: bold">Concerning #3: Public Information??????? Community Relations??????</span></p>
<p>Oh, they so do not want to go there with ME!!!! Simply go through all the Town Council Minutes online at myvaresources.com and see how many times the very word &#8220;public&#8221; is used for anything other than as &#8220;Public Hearing&#8221; or &#8220;public utilities&#8221;.</p>
<p>Public information and community relations do not appear anywhere in the Town Council Meeting Minutes, so this obviously has not be a priority before now. There are a couple of references to the 18 months the Planning Commission worked diligently to develop the comprehensive plan with the public&#8217;s input. Well, we already know what that actually meant.</p>

There are at least 25 articles specifically addressing issues with the existing comprehensive plan and/or the absence of inclusive and effective citizen input.</div>
<p><span>In the Sept. 6, 2005 Minutes it was noted that &#8220;Councilwoman Carter commented that recently much attention has been drawn to evacuation plans. She noted that Christiansburg has an evacuation plan, but that the public may not be aware that a plan is in place. Manager Terpenny replied that while Christiansburg does have an emergency operations plan, it is only direction for public officials on how to handle catastrophes and not a specif plan on how to evacuate citizens.&#8221;</p>
<p style="font-weight: bold">
Concerning #4: Revising the Zoning Ordinance</p>
<p>Over the years, there have been a very few revisions of the overall Zoning Ordinance. In fact, there are significant questions as to whether or not even the State minimum is being met. How effective is any revision of the Zoning Ordinance going to be if they do not do a revision of the Comprehensive Plan? Simply updated the Zoning Ordinance to be up-to-date with minimum State standards may not be what citizens want. Anyone can cut and paste the existing codes from other jurisdictions that are up-to-date and form a Zoning Ordinance. It takes a decent, citizen-based Comprehensive Plan to form the framework around which that Zoning Ordinance is built. If that is lacking, you will simply get &#8216;cherry picked&#8217; pieces that town officials want in the Ordinance with no inclusion of the overall community!<br />
<span style="font-weight: bold">Concerning #5: Promoting the new Aquatic Center</span></p>

April 6, 2004 Town Council Minutes: Resolution for the Department of Conservation and Recreation Grant to Fund a Trail Project to the Future Aquatic Center Site was unanimously approved by Town Council.<br />
April 6, 2004 Ad-Hoc Committee for the Future Aquatic Center created.<br />
May 4, 2004 Adoption of a Resolution for Commonwealth Transportation Board Recreational Access Fund for Future Aquatic Center &#8211; This request is for an access road grant to construct a roadway from Nnorth Franklin Street to the new aquatic center site. Unanimously approved.<br />
October 19, 2004 &#8220;Regarding the Aquatic Center, Town Manager Terpenny requested that the Finance Committee allow fundraising projects to raise additional funds for a fifty-meter competition size pool. Radford University and Virginia Tech are interested in utilizing the pool if it is a fifty-meter pool. This could mean substantial revenue for the Town. The difference in the twenty-five meter pool and fifty-meter pool is approximately 2.5 million dollars. Mayor Linkous commented that plans are to move forward with the construction of a fifty-meter pool while contributions are being sought.</p>
<p>May 1, 2007 Town Council Meeting Minutes: &#8220;Town manager Terpenny said he was recently contacted by USA Swimming regarding possible contracted use of the facility. USA Swimming is willing to work around Virginia Tech&#8217;s scheduling. Projected opening of the facility is Fall 2008.&#8221;</p>
<p>On several occasions it has been pointed out that the Mayor has established a committee to elicit donations from businesses and/or individuals for money for the Aquatic Center. At the most recent town Council meeting, the Mayor admitted that these efforts have not been very successful. So much for the idea of promoting the Aquatic Center. The Town has not been successful at eliciting support from local businesses and citizens. Thankfully, the builder went beyond State borders and was able to find some financing for some of the most expensive embellishments on the Aquatic Center.</p>
<p>The Town has a long history of NOT promoting itself. It has depended upon other groups and governments to do that sort of thing for them, then sat back and complained about the results.</p>
<p>This seems to be a pretty major undertaking on the part of Town officials. They have decided what Christiansburg needs and wants, and they will be deciding how to accomplish those goals. Hopefully, they will also take the time to figure out HOW TO PAY FOR THEM!!!!</p>
<p>The Roanoke Times article speaks of hiring for a new Town position, Public Relations. Well, what about the Planning Staff that was in the budget? Is that position now being dumped although you acknowledged another Planner was necessary due to the work load? And, what about the money in the budget for Recodifying the Code. Neither the position nor the rfp for either of these has been advertised. Are you figuring that people will just forget that you have acknowledged there are problems that need to be dealt with simply because you put the money in the budget?</p>
<p>I got news for ya&#8217;ll: TALK IS CHEAP! All the empty rhetoric in the world will not convince voters. Let&#8217;s see some action. Quit talking and start doing! Oh, and by the way, doing it in front of the public rather than hiding behind emails, phone calls, and secret meetings would be a pretty nice way to start showing that you are really willing to change.</p>
<p>After all in that same Roanoke Times article:</p>
<p>&#8220;The vision for the town&#8217;s future states that in 2020, the goal is for Christiansburg to be known as a retail, commerce and tourist destination, a town of WELL-INFORMED AND ENGAGED CITIZENS, a recreational, cultural and entertainment Mecca, a green community, a clean, healthy and safe place to live, a model for effective land use, a sound financial entity and an interconnected community.</p>
<p>The long-range plan also touts the town&#8217;s downtown; the new Montgomery County courthouse; the national retailers, restaurants and hotels in the community; the aquatics center; the mix of residential, commercial and recreational land uses; and walking trails, multiuse paths and mass transit.&#8221;</p>
<p>Hey! But it&#8217;s all okay. Per the article, the Town Manager and his key staff are going over each of the vision items to determine how to accomplish them. Who the heck needs citizens involved? We have our government taking care of us&#8230;.just like they have for decades now&#8230;.and people are so&#8230;so&#8230;very happy with the results of that!</p>
